The catchmatch.com service (the "Service") is a way for adults to meet each other online. catchmatch.com is provided by WordMark International Corporation, physically located in 1400 Coleman Ave., F16, Santa Clara, CA 95050.
This is a legal agreement ("Agreement") between you and catchmatch.com. Please read the Agreement carefully before registering for the catchmatch.com service. By registering for catchmatch.com, you become a member of the Service (a "Member"), and you agree to be bound by the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a Member. ACCESS OR USE OF THIS SITE OR ITS CONTENTS BY ANY PERSON UNDER THE AGE OF 18 IS

USER CONDUCT
You agree to access and use the catchmatch.com only for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations, pertaining to (a) your use of the catchmatch.com, including any Interactive Area,
(b) the use of any networks or other services connected to the catchmatch.com, and
(c) the communications means by which you connect your modem, computer, or other equipment to the catchmatch.com. By accessing the catchmatch.com, you agree that you will
NOT:
(1) restrict or inhibit any other user from using and enjoying the interactive
features such as chat and forum;
(2) post on the catchmatch.com service, or transmit to other catchmatch.com
members or employees, any defamatory, inaccurate, abusive, obscene, profane,
offensive, sexually oriented, threatening, harassing, racially offensive, or
illegal material, or any material that infringes or violates another party's
rights (including, but not limited to, intellectual property rights, and rights
of privacy and publicity);
(3) post or transmit any information, software or other material which contains a virus or other harmful
component, files, code, or programs designed to interrupt, destroy or limit the
functionality of any computer software or hardware or telecommunication
equipment.
(4) post any photos containing nudity or personal information. catchmatch.com
reserves right, but has no obligation, to reject, modify, crop, or edit any ads/profile or photo that
does not comply with these or other prohibitions on this web site.
(5) include in your ads/profile any telephone number, street addresses, last
names, URL's or e-mail addresses other than where asked for it by our system in
those confidential sections.
(6) alter, damage or delete any content or other communications that are not your own
content or to otherwise interfere with the ability of others to access the catchmatch.com;
(7) include in your ads/profile any offensive anatomical or sexual reference, or
offensive sexually suggestive or connotative language;
(8) authorize others to use your membership, assign or otherwise transfer your
account to any other person or entity;
(9) claim a relationship with or to speak for any business, association, institution or other organization for which you are not authorized to claim such a relationship;
(10) engage in advertising to, or solicitation of, other members to buy or sell
any products or services through the service, or transmit any chain letters,
spam or junk email to other members.
(11) collect personal information about other members without consent.
ONLINE CONTENT
(1) You acknowledge that the catchmatch.com permits access to content that is protected by copyrights, trademarks, and other proprietary
rights. Your use of content shall be governed by applicable copyright and other intellectual property laws. You acknowledge that the catchmatch.com owns a copyright in the "look and feel," i.e., the selection, co-ordination, arrangement and presentation of such
content.
(2) You may not modify, copy, reproduce, transmit, distribute, publish, create derivative works from, display or otherwise transfer or commercially exploit any of the
content, in whole or in part, provided, however, that you may make a reasonable
copies for solely your personal use.
(3) Opinions, advice, statements, offers or other information or content made
available through catchmatch.com are those their respective members/authors, and
not catchmatch.com, and should not necessarily depended on. As members, you are
solely responsible for such content. catchmatch.com does not guarantee the
accuracy, completeness or userfulness of any information on the web site.
(4) You acknowledge that catchmatch.com may include various interactive areas, including but not limited to
ads, chat, guestbook, and forum. These interactive areas allow feedback to catchmatch.com and real-time interaction
among users. You further understand that catchmatch.com does not control the
messages. catchmatch.com is not responsible for content within any interactive
area. catchmatch.com reserves the right to prohibit conduct, communication or
content within an interactive area, or to monitor, edit, refuse to post, or to remove any
content, in whole or in part, which it deems in its sole discretion to (a) violate the then-standard provisions of this Agreement or any other standard, written catchmatch.com policy in effect at that time,
(b) be harmful to the rights of any User, the catchmatch.com, or other third parties,
(c) violate applicable law, or (d) be otherwise objectionable.
(5) catchmatch.com may contain links to/from other web sites or resources. We
neither control nor endorse such other web sites, nor have we reviewed any
content that appears on such other web sites. You acknowledge and agree that we
shall not be held responsible for the legality, accuracy or inappropriate nature
of any content, advertising, products, services or information located on or
through any other web sites or for the operation or policies of any such web
sites, nor for any loss or damage caused or alleged to have been caused by the
use of or reliance on any such web sites or such content or other information.
(6) It is possible that other members, users (including unauthorized users, or
"hackers") may obtain, post or transmit your personal information as
the result of your use of the service, and harass or injure you. catchmatch.com
is not responsible for the use of any personal information that you may choose
to disclose on this web site. Please be cautious when you decide to release your
personal information.
REFUND
If you are dissatisfied with catchmatch.com for any reason you may request a refund within 7 working days from the date of invoice. To request a refund please contact catchmatch.com, by email, with the reasons for your cancellation plus a copy of your user registration details and a copy of your invoice. The user registration details and the invoice are sent to the user upon joining catchmatch.com. When payment is made to catchmatch.com by credit card, catchmatch.com will refund in full any payments to the Users credit card. All refunds will be made within 30 days of the users written cancellation.
TERMINATION
catchmatch.com may terminate or temporarily suspend your access to all or any part of catchmatch.com, without notice, for conduct that catchmatch.com believes is a violation of this Agreement or any policies or guidelines posted by catchmatch.com, or for other conduct which the catchmatch.com believes, in its sole discretion, is harmful to catchmatch.com or other Users. catchmatch.com will provide a written explanation of any Termination upon request and will consider refund or part refund of any payments made to catchmatch.com. No payments will be refunded where it can be shown that the User purposefully violated our Terms and Conditions
DISCLAIMER OF WARRANTY
Please use your best judgement in evaluating all information contained or opinions expressed on catchmatch.com.
catchmatch.com does not warrant that your use of the service or the web site
will be secure, uninterrupted, always available or error-free, or meet your
requirements.
LIMITATION OF LIABILITY
(1) In no event will catchmatch.com be liable to you for any incidental,
consequential, or indirect damages (including, but not limited to, damages for
loss of data, loss of programs, cost of procurement of substitute services or
service interruptions) arising out of the use of or inability to use the
catchmatch.com service, even if catchmatch.com or its agents or representatives
know or have been advised of the possibility of such damages, or to any person
other than you. Notwithstanding anything to the contrary contained herein,
catchmatch.com's liability to you for any cause whatsoever, and regardless of
the form of the action, will at all times be limited to the amount paid, if any,
by you to catchmatch.com for the service during the term of membership.
(2) The User shall give catchmatch.com a reasonable opportunity to remedy any matter for which We are liable before You incur any costs and/or expenses in remedying the matter Yourself. If You do not do so We shall have no Liability to You.
(3) The User shall produce to catchmatch.com written evidence of any claims for which it is alleged that catchmatch.com are liable together with written details of how any loss was caused by Us and the steps you have taken to mitigate the loss before catchmatch.com shall have any Liability for the claim by You.
(4) - catchmatch.com shall have no Liability to You to the extent that You are covered by any policy of insurance and You shall ensure that Your insurers waive any and all rights of subrogation they may have against Us.
(5) - catchmatch.com shall have no Liability to You arising out of Your use of the Service and/or Your reliance on any information and/or other material Posted on the Service or Posted to You by other Members.
(6) - You shall be under a duty to mitigate any loss, damage, costs or expenses that You may suffer.
INDEMNITY
The user agrees to indemnify, defend, hold us and keep indemnified catchmatch.com from and against any and all claims, losses, proceedings, lost profits, damages, liabilities, awards, expenses, costs (including increased administration costs and legal costs on a full indemnity basis), claims, actions and any other losses and/or liabilities suffered by Us and arising from and/or relating to Your use of the Service, information and/or other material Posted on the Service by You and/or arising from or due to any breach of contract, any tortious act and/or omission and/or any breach of statutory duty by You.
catchmatch.com may revise this Agreement or any other policy at any time and from time to time, and such revision shall be effective two (2) days upon posting notice of such revision prominently on the catchmatch.com. You agree to review this Agreement periodically to be aware of such revisions. If any such revision is unacceptable to you, you must discontinue accessing the catchmatch.com. Your continued accessing and use of the catchmatch.com following notice of any such revision shall conclusively be deemed acceptance of all such revisions.
All logos, brand names, products, trademarks and service marks appearing herein may be the trademarks or service marks of their respective owners. References to any trademark, service mark and links to or from catchmatch.com have been done strictly for clarification and identification and does not constitute endorsement by catchmatch.com of the products, services or information offered by the owner of such trademark, service mark or link or endorsement of the catchmatch.com by such trademark, service mark or link owner.
